1. PURPOSE OF THIS DOCUMENT

Pathway To Credit Freedom LLC (“Pathway To Credit Freedom,” “Company,” “we,” “us,” or “our”) respects the privacy of individuals who contact or receive services from our Company.

This document explains how information may be received when a prospective or existing client is referred to Pathway To Credit Freedom by a family member, friend, business associate, or other third party.

It also explains the distinction between HIPAA-protected information and other personal or financial information that may be voluntarily provided to our Company.

2. HIPAA NOTICE

HIPAA means the Health Insurance Portability and Accountability Act.

HIPAA is a federal law primarily governing certain health plans, health care clearinghouses, health care providers that conduct certain electronic transactions, and their business associates.

Pathway To Credit Freedom LLC is a credit and financial services company and is not representing that it is a HIPAA-covered entity or health care provider merely because it may receive personal information from a client or referral source.

Nothing in this document should be interpreted as a statement that Pathway To Credit Freedom LLC is a HIPAA-covered entity or business associate unless the Company is legally determined to fall within one of those categories for a particular activity.

Where another applicable privacy law governs information received by the Company, the Company will handle that information according to applicable law and its Privacy Policy.

3. CLIENT PRIVACY

Clients should provide personal, financial, credit, tax, identification, and other sensitive information only through communication methods or systems authorized by Pathway To Credit Freedom LLC.

Clients should not provide information belonging to another person unless they have the legal authority or permission to provide that information.

4. FAMILY & FRIEND REFERRALS

Pathway To Credit Freedom LLC may receive prospective-client information through referrals from family members, friends, current clients, business associates, or other individuals.

For example, a person may contact the Company and provide information for a family member or friend whom they believe may benefit from the Company’s services.

A referral does not automatically establish a client relationship.

The referred individual must independently communicate with Pathway To Credit Freedom LLC and complete any required enrollment, authorization, disclosure, identity-verification, and service-agreement requirements before services are provided.

5. INFORMATION VOLUNTARILY PROVIDED BY A THIRD PARTY

If a family member, friend, referral source, or other third party voluntarily provides Pathway To Credit Freedom LLC with information about another person, the Company will not be responsible for the fact that the third party chose to provide that information when the Company did not request or require the third party to disclose it.

Examples may include:

Name;
Telephone number;
Email address;
Address;
General information about the person’s credit situation;
Information about the person’s interest in the Company’s services;
Referral information; or
Other information voluntarily supplied by the referral source.

The referral source is responsible for ensuring that they have appropriate permission or authority to provide information belonging to another person.

6. NO RESPONSIBILITY FOR UNAUTHORIZED DISCLOSURES BY REFERRAL SOURCES

Pathway To Credit Freedom LLC is not responsible for a family member, friend, referral source, or other third party independently choosing to disclose another person’s private, personal, financial, medical, credit, or other information to the Company without the knowledge or authorization of that individual, provided that the Company did not request, encourage, or knowingly solicit an unauthorized disclosure.

Upon becoming aware that information was provided without appropriate authorization, the Company may take reasonable steps to limit further use or disclosure of that information when appropriate and legally required.

7. CLIENT AUTHORIZATION

A prospective client who wishes to receive services must provide any authorizations required by the Company and applicable law.

Where legally required, the Company may require the individual to personally confirm their identity and authorize the Company to obtain, review, use, or communicate information necessary to provide the requested services.

A family member or friend cannot automatically authorize services on behalf of another person simply because they referred that person.

8. NO THIRD-PARTY ACCESS TO CLIENT INFORMATION

A referral source does not automatically have the right to receive information about the referred individual’s account.

Once a person becomes a client, Pathway To Credit Freedom LLC may require written authorization before discussing account-specific information with a family member, friend, spouse, representative, or other third party, except where disclosure is otherwise permitted or required by law.

9. RESPONSIBILITY FOR INFORMATION PROVIDED

Clients are responsible for the accuracy of information they personally provide to Pathway To Credit Freedom LLC.

If information is provided by a third party, the Company may rely on that information for the limited purpose for which it was provided until the prospective client confirms, corrects, or replaces the information.

The Company does not guarantee the accuracy of information supplied by a referral source.

10. PROTECTION OF INFORMATION

Pathway To Credit Freedom LLC takes reasonable measures to protect information received in connection with its services.

However, no electronic communication system, internet transmission, email account, text message, online platform, or storage system can be guaranteed to be completely secure.

Clients and referral sources should avoid sending unnecessary sensitive information through unsecured communication methods.

11. MEDICAL OR HEALTH INFORMATION

Pathway To Credit Freedom LLC generally does not require medical or health information to provide its ordinary credit and financial services.

Individuals should not provide medical or health information unless specifically requested for a lawful and necessary business purpose.

If health information is inadvertently provided, the Company will handle it in accordance with applicable law and its internal privacy practices.

12. REFERRAL DOES NOT EQUAL ENROLLMENT

A referral does not mean that the referred person has:

Purchased services;
Signed a contract;
Authorized credit services;
Authorized access to their credit report;
Authorized disclosure of their information;
Become a client; or
Agreed to any payment obligation.

The individual must independently complete the Company’s required enrollment process.

13. NO GUARANTEE REGARDING THIRD-PARTY DISCLOSURES

Pathway To Credit Freedom LLC cannot control what a family member, friend, referral source, current client, or other third party chooses to disclose before the information reaches the Company.

The Company is not responsible for a third party’s independent decision to disclose information that the Company did not request or require them to disclose.

Nothing in this section limits the Company’s responsibilities under applicable privacy, consumer-protection, data-security, or other laws.

14. COMPLIANCE WITH APPLICABLE LAW

Nothing in this document is intended to eliminate, waive, or limit any privacy right or legal protection that cannot legally be waived.

Pathway To Credit Freedom LLC will comply with applicable federal and state privacy, consumer-protection, data-security, and confidentiality requirements applicable to its services.

By signing below, the undersigned acknowledges that they have read and understand this Privacy, HIPAA & Third-Party Referral Information Disclosure.

The undersigned understands that:

A referral does not automatically establish a client relationship;
A referral source is responsible for obtaining appropriate permission or authority before voluntarily providing another person’s private information;
Pathway To Credit Freedom LLC is not responsible for an unauthorized disclosure independently made by a third party when the Company did not request, encourage, or knowingly solicit that disclosure;
A referred individual must independently authorize services and provide required information before services are performed; and
This document does not waive any rights or protections provided by applicable law.
